Terms of Service

1. Service Description

callchloe.ai is an AI-powered phone secretary designed for real estate agents. The service:

• Answers your calls 24 hours a day, 7 days a week
• Qualifies incoming leads and collects caller information (name, phone, email, reason for calling)
• Checks your calendar availability and books appointments on your behalf
• Sends you instant call summaries via SMS and email after each call
• Sends callers appointment confirmations and follow-up information via SMS

The service relies on third-party AI voice technology and telephony infrastructure. While we aim for natural, accurate conversations, the AI secretary is not a substitute for professional legal, financial, or real estate advice.

2. Eligibility

To use callchloe.ai, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into a binding agreement
• Provide accurate and complete information during registration

3. Account Registration

• You must provide accurate, current, and complete information during registration
• You are responsible for maintaining the confidentiality of your login credentials
• You accept responsibility for all activity that occurs under your account
• You must notify us immediately of any unauthorized access to your account

4. Free Trial

• New users receive 50 free AI call minutes over a 14-day trial period
• A valid credit card is required at sign-up
• Your trial auto-converts to a paid subscription when your minutes are used or the trial period ends
• Cancel before conversion and you will not be charged
• We reserve the right to modify free trial terms at any time

5. Pricing, Billing & Payment

All prices are in United States Dollars (USD).

Subscription plans

Billing details

• Monthly plans are billed on the same date each month via Stripe
• Annual plans are billed as a single upfront payment for 12 months
• Subscriptions auto-renew unless cancelled before the next billing cycle
• Minute overages are billed automatically at your plan's per-minute rate
• Additional minute packs are available from your Billing dashboard
• Payments are non-refundable except as required by applicable law
• We will provide at least 30 days notice before any price changes take effect

6. Cancellation

By you

You may cancel your subscription at any time from your dashboard or by emailing hello@callchloe.ai. Your AI secretary will continue answering calls until the end of your current billing period.

After cancellation

• Your AI secretary stops answering calls at the end of the billing period
• Your data remains available for download for 90 days
• All account data is permanently deleted after 90 days

7. Acceptable Use

callchloe.ai is for legitimate real estate business use only. You agree not to:

• Use the service for any illegal activity or purpose
• Send spam, unsolicited marketing messages, or bulk SMS via the service
• Impersonate another person or entity
• Attempt to gain unauthorized access to our systems or other users' accounts
• Harass callers or use the service to facilitate harassment
• Reverse-engineer, decompile, or extract the AI's underlying technology
• Violate CASL, TCPA, PIPEDA, or any other applicable communications or privacy law
• Resell or white-label the service without written authorization

8. SMS Terms

callchloe.ai sends SMS messages on your behalf as part of the service. By using the service, you acknowledge and agree:

• SMS messages are sent to callers and agents for transactional purposes only — appointment confirmations, call summaries, lead alerts, and listing information
• You are responsible for ensuring that your use of SMS features complies with all applicable laws, including CASL (Canada) and TCPA (United States)
• Callers provide verbal consent during the call when they share their phone number and agree to receive follow-up communications
• Recipients can reply STOP at any time to opt out of future text messages
• Recipients can reply HELP for assistance, or contact hello@callchloe.ai
• Message frequency varies based on call volume and activity
• Standard message and data rates may apply

9. Call Recordings & Transcriptions

• All calls handled by your AI secretary are recorded and transcribed for the purpose of generating call summaries and maintaining quality
• Recordings and transcriptions are stored securely and accessible from your dashboard
• You are responsible for complying with call recording laws in your jurisdiction, including one-party or two-party consent requirements
• You may download or delete recordings from your dashboard at any time

10. AI Limitations

The AI secretary is designed to handle common real estate call scenarios, but it has limitations:

• The AI may occasionally misunderstand callers, especially in noisy environments or with heavy accents
• The service is not error-free and should not be solely relied upon for critical communications
• The AI does not provide legal, financial, tax, or professional real estate advice
• The AI does not make representations about property values, commissions, or market conditions
• You should review call summaries and follow up with callers as needed

11. Intellectual Property

• Our platform — callchloe.ai, including the AI technology, software, design, and branding, is owned by us and protected by intellectual property laws
• Your license — we grant you a limited, non-exclusive, non-transferable license to use the service for the duration of your subscription
• Your data — you retain full ownership of your leads, contacts, call recordings, and all data generated through your use of the service

12. Privacy

Your use of callchloe.ai is governed by our Privacy Policy, which describes how we collect, use, share, and protect your personal information. By using the service, you agree to the terms of our Privacy Policy.

13. Third-Party Services

callchloe.ai integrates with third-party services to deliver its functionality. Each is subject to its own terms of service:

We are not responsible for the availability, performance, or terms of third-party services.

14. Disclaimer of Warranties

The service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or free of harmful components.

15. Limitation of Liability

To the maximum extent permitted by applicable law:

• We are not liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, lost data, or business interruption
• We are not liable for missed calls, lost leads, errors made by the AI secretary, or third-party service failures
• Our total aggregate liability for all claims arising from your use of the service is limited to the total fees you have paid to callchloe.ai in the 12 months immediately preceding the claim

16. Indemnification

You agree to indemnify, defend, and hold harmless callchloe.ai, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from:

• Your use of the service
• Your violation of these Terms
• Your violation of any applicable law or regulation
• Your infringement of any third-party rights

17. Modifications to the Service

We reserve the right to modify, suspend, or discontinue any part of the service at any time with reasonable notice. We will provide at least 30 days notice for material changes that affect your subscription or use of core features.

18. Changes to These Terms

We may update these Terms of Service from time to time. When we do, we will revise the “Last updated” date at the top of this page. For material changes, we will notify you by email at least 30 days before the changes take effect. Your continued use of the service after changes are posted constitutes acceptance of the updated terms.

19. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Quebec and the federal laws of Canada applicable therein. Any disputes arising from these Terms or your use of the service will be resolved exclusively in the courts of Montreal, Quebec, Canada.

If a dispute arises, both parties agree to attempt good-faith negotiation for 30 days before pursuing legal action.

20. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

21. Entire Agreement

These Terms of Service, together with our Privacy Policy and Fair Use Policy, constitute the entire agreement between you and callchloe.ai regarding your use of the service, and supersede all prior agreements, understandings, and communications.
